The San Francisco Board of Appeals on Wednesday upheld the Municipal Transportation Agency—s denial of a ramp taxi medallion and a requested time waiver for applicant Masood Charsugi, finding the applicant was not eligible based on the initial 2003 offer letter and subsequent deficiencies.
Jordana Thigpen, Enforcement and Legal Affairs Manager at the SFMTA Division of Taxis and Accessible Services, presented the agency—s chronology and argued the denial rested on multiple independent bases: the applicant failed to respond to an earlier offer, did not hold a required A-card at the controlling time, and lacked the requisite driving experience. "He was never eligible," Thigpen said, listing the reasons the agency relied on to deny the permit and the time waiver.
Appellate counsel said Charsugi exceeded full-time driving requirements in 2007 and 2008, submitted waybills and completed training, and therefore was entitled to the one-year waiver under the Taxi Commission resolution. Counsel argued denying the waiver would create a "vicious circle" in which changing driving-hour rules indefinitely pushed eligibility out of reach.
After questions from commissioners about the timing of ordinance changes and whether defective notices produced procedural unfairness, the board voted 5-0 to uphold the MTA—s decision.
What—s next: The decision leaves Charsugi on the waiting list for a regular medallion and preserves the MTA—s reasoning that the applicant was not eligible for a ramp medallion under the controlling documents that issued in 2003 and later years.
