The Board of Appeals on Dec. 10 upheld a permit to install a new gas furnace and related work at 1142 Jackson St., Unit 4, and attached two conditions intended to reduce tenant hardship: the tenant may leave large furniture stored in the unit under agreed protections, and the permit’s execution period is limited to six weeks from the date the tenant temporarily vacates.
Appellant Kyle Wong urged the board to require the landlord to repair an existing steam system instead of installing a new furnace that would require the family to relocate. The landlord, Jerry Chang, and his contractor said alternatives (electric heat) were not feasible due to Title 24 and cost, and that a gas furnace was the most reliable option. The permit holder offered concessions — restricted work hours, storage for furniture and an effort to complete the project promptly.
Commissioners expressed concern about tenant displacement but also noted that the Department of Building Inspection does not prescribe a specific solution if multiple compliance options exist. After debating whether to deny the permit and force the owner back to the drawing board, the board voted 5–0 to uphold the permit with the two conditions described.
The board asked staff to ensure the conditions are included in the final notice of decision and emphasized parties should continue to negotiate timetables and accommodations to reduce the burden on tenants while the work proceeds.
