Commissioner Bill Lee moved the continuances; the motion passed after a roll call vote.
Commissioner Antonini asked that the city attorney provide written confirmation that planning- and zoning-code changes proposed for the Market Octavia area apply only to properties inside the plan boundaries, citing public concerns that the new rules not be applied elsewhere in the city. Planning staff said earlier questions about noticing and applicability had been raised and that a zoning-administrator letter of determination addressing noticing was expected; commissioners requested a formal legal opinion in writing.
Planning staff said they had recommended the indefinite continuance for the third item because they were not prepared to support the original application and believed the project sponsor might file an alternate conditional use under a different code section. Commissioners agreed the sponsor should decide whether to pursue that alternate path and noted any future action on the original application would require a formal commission hearing.
The commission’s action keeps the Market Octavia items on a future calendar so staff can supply additional materials and the commission can consider further hearings and any informational presentations.
What’s next: The continued items are set for March 22; staff will circulate revised materials in advance and the commission requested the city attorney’s written clarification on boundary applicability.
