Commissioner Frank Fung, after reviewing mailed notices, concluded the notice had been sent; Commissioner Robert Holland noted only one discrepancy in the addressed list and determined the department’s 03/11 notice was accurate for the prior occupant. Vice President Michael Garcia moved to deny the jurisdiction request and the board voted 3–2 not to grant jurisdiction (four votes required). The board explained that denial means no further appeal on that item will be calendared at this time.
