The Board of Appeals considered an appeal by Brock Pryor challenging a permit issued for 1247 Palou Avenue to legalize rooms and abate notices regarding an illegal kitchen. Pryor raised concerns about overcrowding, lack of timely notice of the permit issuance and neighborhood impacts. The appellant said prior inspections and DBI follow-up had been incomplete.
Permit-holder counsel said the permit provides a path to comply with an abatement order and will clarify occupancy and unit counts. Planning Department staff displayed floor plans and said a zoning bulletin governing ground-floor rooms allowed either a wet bar or a full bath but not both; they told the board the combination as proposed was an error in the review.
Commissioners discussed the balance of remedying an unlawful occupancy condition through proper permits against neighbor concerns. Commissioner Garcia moved to uphold the permit on the condition that the wet bar be deleted (retaining bathrooms as proposed). The motion passed 5-0. The board noted a CFC (certificate of final compliance) and building-permit inspections will clarify the unit count and occupancy status.
