The Planning Commission unanimously approved an in-kind agreement for 333 Fremont Street that credits the project sponsor for construction of a public mid-block pathway and a permanent public easement toward the Rincon Hill community infrastructure impact fee. Planning staff said the project had deposited the full fee plus interest ($769,142) in escrow; staff recommended recognizing $573,000 in in-kind value ($240,000 for the pathway construction and $333,000 for the permanent easement), with the remaining $196,142 transferred into the SoMa stabilization fund.
Josh Vazquez of planning staff described the pathway as a perpendicular mid-block connection between 333 Fremont and an adjacent approved project on 399 Fremont; the easement would make the pathway a permanent public right-of-way. Commissioners asked about the formula used to allocate funds to the SoMa fund; staff said the practice had been to transfer roughly 25% of fees into the SoMa stabilization obligation until the $6,000,000 commitment is met, and that proportions could vary project to project.
After brief questions about reporting and oversight — including regular updates on the Rincon Hill and SoMa fund allocations — the commission voted to approve the in-kind credit and the transfer of residual funds. The motion passed on a unanimous roll call.
