The Board of Appeals voted 5‑0 on Dec. 6 to uphold a permit for work at 2719 Filbert Street while attaching six conditions negotiated on the record to address neighbors’ visibility and privacy concerns.
Appellant Chris Jake and several neighbors had challenged inconsistent plan pages and the visibility and height of a proposed roof hatch, vents and potential future roof‑deck features. Architect Brett Gladstone presented revised drawings and proposed conditions limiting roof‑hatch height and the size of external blowers; neighbors asked the board to add protections against future roof‑deck permits.
The board adopted conditions that require: (1) a roof‑hatch profile no higher than 1 inch above the roof on the west elevation and no higher than 5 inches above the adjacent roof on the east elevation (as shown on the November 15 roof plan); (2) construction plans to be kept on site during work and made available to neighbors on request; (3) an external range‑hood blower limited to 6 inches in height and no larger than 21 by 27 inches horizontally; (4) no pipe or flue higher than 6 inches above the roof where it intersects; (5) revised plans reflecting these conditions to be routed through staff and sent to appellants; and (6) a block‑book notification (BBN) to be filed and a Notice of Special Restriction recorded to preserve the BBN notice for the year so neighbors receive notification if a future permit for a roof deck is filed.
Lawrence Kornfield, Chief Building Inspector, explained that roof hatches normally require a curb for waterproofing and that DBI would review the submitted revisions for code compliance; Planning staff confirmed roof decks require referral and would be visible to planning reviewers. Architect Mohammed Sadria described a recessed curb detail that would allow water proofing while minimizing the visual profile of the hatch.
The board told staff to route the revised plans for priority review and to record the NSR per the parties’ agreement; the motion passed unanimously.
