The San Francisco Board of Appeals on Oct. 19 sustained the Planning Commission's denial of a permit for Green Cross to operate a medical cannabis dispensary at 2701 Leavenworth, after hours of testimony from city staff, legal counsel and more than 150 members of the public.
The board heard presentations from Lawrence Badner, the city's zoning administrator, who explained that although the planning staff did not find the proposed location legally prohibited under the code as currently interpreted, the Planning Commission had concluded exceptional and extraordinary circumstances existed in the area (including the district's tourist orientation and nearby child-focused programs) and voted to deny discretionary review. Joe Elford, attorney for Green Cross and appellant Kevin Reed, urged the board to overrule that decision and grant a conditional permit so the dispensary could demonstrate compliance with neighborhood conditions.
