Board upholds permit for exhaust devices at Lakewood complex with dampers, caulking and manual switch

The Board of Appeals upheld a Department of Building Inspection permit for installation of exhaust/dehumidifier units at the Lakewood (Delaware Lakewood LLC) apartment complex, imposing conditions intended to reduce energy and noise impacts.

Lawrence Kornfield, chief building inspector, told the board the proposed devices were not nationally listed products and required technical review. DBI had initially required manual shutoff switches and other corrections; after receiving guidance from the California Energy Commission that the devices functioned like exhaust fans rather than space‑conditioning systems, DBI revised its position to require a backdraft damper, caulking around the exterior penetration and compliance with electrical corrections identified by inspectors.

Opponents raised questions about efficacy, energy costs for tenants and whether Title 24 (California Energy Code) compliance had been demonstrated. Appellant Ross Wilkinson argued the machines may not address underlying roof leaks that cause mold and raised concerns about missing Title 24 documentation. The permit holder’s representative, Jeff Margulies, said the manufacturer supplies dampers and that the permit holder would install the caulking and an on/off switch.

After deliberation the board voted 4–1 to uphold the permit with conditions requiring a backdraft damper, exterior caulking, and a manual on/off switch; one commissioner voted no, citing skepticism about the devices’ effectiveness.

The board noted that the conditions are to be enforced through the permit and that contractors must meet DBI electrical‑inspection corrections before final approval.
