The Land Use and Transportation Committee on July 15 voted 3–0 to recommend interim zoning controls that would require conditional‑use authorization for any change of use away from a health or social‑services use in the Upper Market Street commercial transit district and the Castro Street commercial district for an 18‑month period.
President Erin Peskin, the sponsor of the resolution, said the interim controls were prompted by a threat of eviction at Queer Life Space, an LGBTQ mental‑health and substance‑use services organization that has operated in the Castro for more than a decade. Peskin described the measure as intended to “protect mental health care that responds to the unique needs of the LGBTQ community.”
The clerk noted the item affirms the Planning Department’s determination and makes findings of consistency with the general plan and the eight priority policies in Planning Code section 101.1. The item was agendized as a committee report and may be considered at the Board meeting on 07/16/2024.
The committee opened public comment; no speakers appeared. Peskin moved to send the resolution to the full Board as a committee report with a positive recommendation; Vice Chair Dean Preston and Chair Mirna Melgar joined her vote.
If approved by the Board, the interim controls would place a temporary procedural requirement on changes of use in the two districts; substantive details of how the conditional‑use review would be applied will be set out in the ordinance and accompanying staff report to the Board.
