Committee approves DPH request to access LiveScan records for massage-business licensing

The committee forwarded a resolution authorizing the Department of Public Health's Environmental Health Branch to access state and federal summary criminal-history records (LiveScan/FBI) for massage-business licensing, a change DPH said will add LiveScan as an alternative to exclusive SFPD checks and improve equity for small business owners.
The Department of Public Health asked the committee to authorize state- and federal-level summary criminal-history access so DPH can perform LiveScan background checks for massage-business licensing. Patrick Fostal, director of the Environmental Health Branch, said the change removes an exclusive requirement to use the San Francisco Police Department for background checks and adds LiveScan as an alternative to make the process easier and more equitable for operators — particularly businesses owned by women of color.
"The resolution before you today authorizes the San Francisco Department of Public Health to access state and federal level summary criminal history for the purpose of licensing, permitting, and or certification of massage business applications," Fostal said, adding that DOJ and FBI requirements for a LiveScan account make the resolution necessary.
The committee voted to forward the resolution to the full Board as a committee report with a positive recommendation. No public commenters spoke on the item during the hearing.
