Committee forwards amendments to Fair Chance (Ban the Box) and college-admissions rules to full board

The Public Safety and Neighborhood Services Committee on July 11 voted to forward amendments to the Fair Chance Ordinance (commonly known as Ban the Box) and the Beyond the Box and College Admissions Ordinance to the full Board of Supervisors with a positive recommendation.
Bill Barnes, representing the City Administrator, summarized the package of amendments: standardize and clarify the notice employers must post summarizing applicant and employee rights under Fair Chance; transfer enforcement of college-admissions aspects of the ordinance from the Office of Labor Standards Enforcement (OLSC) to the Human Rights Commission (HRC); require colleges and universities to notify applicants in recruiting materials and on application forms; require notices to be provided in English, Spanish and Chinese and in any other language spoken by more than 5% of the city's population; and revise private right-of-action rules to give the City Attorney notice and an opportunity to decide whether to assist before lawsuits proceed.
Barnes said the changes are intended to make the notice concise and accessible for workers and applicants and that both OLSC and HRC support the transfer of enforcement authority for college admissions. "HRC is better positioned to enforce a law related to college admissions because the applicant doesn't have an employment relationship with the school," Barnes told the committee. There were no public speakers on the item. Chair Rafael Mandelman moved to forward the amendments to the full Board with a positive recommendation; the committee took that motion without objection.
The committee record indicates the amendments will be scheduled for Board consideration on July 23, 2019.
