Committee forwards ordinance to suspend parts of local menu-labeling law after state preemption

The Government Audit & Oversight Committee on Nov. 3 forwarded an ordinance that would add section 468.9 to the San Francisco Health Code to suspend sections 468.3–468.8 of the local menu-labeling ordinance, citing state preemption.
Supervisor Tom Ammiano said that after the city's work on menu-labeling helped shape statewide disclosure expectations, state legislation had preempted parts of the local law and the local ordinance needs adjustment. He recommended forwarding the suspension ordinance to the full Board with a committee recommendation and suggested that San Francisco advocates consider working to amend the state law so it meets the higher local standards.
There was no public testimony on the item. The committee closed public comment and forwarded the ordinance as a committee report with recommendation without objection.
The full Board will receive the suspension ordinance for consideration; committee members noted the forward was a technical step to align local code with state law.
