The Budget & Finance Subcommittee reviewed a proposed ordinance to appropriate $1,925,000 from the General Fund reserve and $360,000 from the Library Preservation Fund to cover litigation expenses incurred by multiple departments in the class‑action Americans with Disabilities Act case Ivana Carolla v. City and County of San Francisco.
Deputy City Attorney Cheryl Adams explained that the case, filed in February 2007, addresses claims that city facilities, park areas, open space and rights of way are not accessible; the trial concluded last week and the city is in post‑trial briefing. Adams said litigation costs have been split among departments and the appropriation is intended to cover existing and some post‑trial costs; additional briefing and possible appeals could require further work. Controller Ben Rosenfield confirmed that any unused appropriated funds would close back to the general fund reserve at fiscal year‑end.
The committee had no public comment on the item and moved it forward with a positive recommendation.
