Malgar said the proposed ordinance would waive the Department of Public Works’ annual encroachment assessment so the community could raise funds and work with the property owner to reinstall a railing with the owner’s consent. John Quang of DPW clarified the waiver is only for the annual assessment; applicants must still pay administrative and inspection fees and DPW will process permits as required. DPW staff noted the segment of 40 Eighth Avenue is an unimproved right‑of‑way and fronting property owners retain maintenance responsibility to the midpoint of the street.
After limited public comment, the committee moved the item forward with recommendation without objection. The committee asked DPW to expedite permit processing to facilitate the community effort to reinstall the railing.
