Committee recommends Type 40 beer license for Marina Theater with operating conditions

SAN FRANCISCO — The Public Safety and Neighborhood Services Committee on Nov. 8 recommended that the full Board of Supervisors approve a Type 40 on‑sale beer license for the Marina Theater, subject to 11 conditions set by Alcoholic Beverage Control and ALU staff.
Inspector Nellie Gordon of the San Francisco Police Department presented the Police Code/PCN report for the applicant, Frank Lee Junior doing business as Marina Theater at 2149 Chestnut Street. Gordon said Northern Police Station raised no opposition, but the location sits in Plot 507 (classified as a high‑crime area) and Census Tract 128 (an area of undue concentration). The report noted no letters of support or protest filed with the California Department of Alcoholic Beverage Control (ABC).
ALU and the police recommended conditions intended to limit nuisance and public‑safety risks. The conditions presented included limiting sale, service and consumption to 10 a.m. to 1 a.m. daily; restricting in‑auditorium sales to concession stands (no ambulatory vendors); prohibiting points of sale inside theater auditoriums; requiring a valid ticket to purchase alcoholic beverages for in‑auditorium consumption; limiting purchases to two alcoholic beverages per transaction; banning off‑sale alcohol; requiring alcohol to be served in containers no larger than 16 ounces and to be visually distinct from non‑alcoholic containers; requiring staff to monitor activity in auditoria while alcoholic service is in effect; prohibiting loitering adjacent to the licensed premises; requiring litter removal in adjacent areas under licensee control; and requiring graffiti removal within 72 hours.
No representative for Marina Theater was present at the hearing and no public speakers came forward on the item. A committee member moved to forward the matter to the Board with a positive recommendation; the motion passed without objection.
