The Land Use Committee voted to forward an ordinance to the full Board to vacate a portion of Panama Street adjacent to 10 Niantic Street and accept sidewalk improvements, but sent the item without a committee recommendation after debate and a 2–1 roll-call vote.
Javier Rivera of Public Works said an approximately 4-by-40-foot section was built over the public right-of-way during construction at 10 Niantic; to clear title the city was asked to vacate the area and the developer agreed to build a new 500-foot ADA-compliant sidewalk on Niantic Street connecting to an overpass to Daly City BART. Rivera said no city agencies objected during circulation.
Supervisor Shane Kim said he would vote against moving the item forward because the project sponsor had built on public land without prior approval, and he raised tenant-related concerns, including evictions that vacated three units and active Department of Building Inspection complaints on the site. Kim asked that the committee continue the item until the city could explain how the overbuild occurred. After discussion about options, the committee decided to place the item on the April 3 Board agenda without recommendation and asked staff to provide the additional information Supervisor Kim requested. The clerk recorded two ayes (including Chair Tang) and one no (Vice Chair Kim).
