Committee backs extension of interim controls for indoor cannabis cultivation; staff to aim for permanent rules by January

The Land Use & Transportation Committee voted July 17 to forward a resolution extending interim zoning controls that require conditional-use authorization for indoor agriculture uses, including cannabis cultivation, while the city develops permanent regulations.
Lisa Pagan of the Office of Economic and Workforce Development (OEWD) told the committee that Proposition 64 (the adult-use marijuana act) created new business opportunities but also raised concerns about preserving industrial (PDR) land and avoiding geographic overconcentration of cannabis cultivation in neighborhoods such as Bayview, Mission and SoMa. Pagan said departments have been coordinating since the mayor's executive directive and recommended creation of an Office of Cannabis to streamline regulation and licensing across departments.
Staff said the state was still developing licensing regulations (staff and supervisors cited a goal of January 1 for state licensing) and that the city would aim to have permanent local regulations by January 2018. Supervisor Peskin asked for a shorter interim-extension date; staff agreed to amend the resolution to specify that the controls remain in effect until 12/31/2017 or until adoption of permanent regulations, whichever comes first. The committee forwarded the resolution with a positive recommendation.
