Committee moves to correct DTHP code language, removing unintended 10‑year occupancy requirement
Summary
The committee recommended an ordinance to the full Board to correct Chapter 47 of the Administrative Code so that the Displaced Tenant Housing Preference (DTHP) no longer contains an unintended 10‑year residency requirement for Ellis Act/OMI‑displaced tenants; the Mayor’s Office and City Attorney concur the board intended removal.

Amy Chan of the Mayor’s Office explained that Chapter 47 of the Administrative Code establishes a sequence of housing preferences for city affordable housing (COP holders, DTHP holders, neighborhood preference, live/work preference). She said the Board had intended in a prior amendment to remove a 10‑year occupancy requirement for eligibility under the DTHP but that the language in section 47.2 was not fully stricken. Chan said the City Attorney concurs that the Board’s intention was to remove the occupancy requirement, and the ordinance before the committee corrects that oversight.
Chan told the committee staff from the Mayor’s Office of Housing were present to answer questions. There was no public comment on the item.
Supervisor Katie Tang moved to send the ordinance to the full Board with a positive recommendation; Chair Mark Farrell took the motion without objection. The ordinance will move to the full Board agenda for consideration.
