The San Francisco Rules Committee on March 9 advanced a technical amendment to the city—s paid parental leave policy to ensure the exemption for employers who provide fully paid family leave remains consistent with California law.
Supervisor Stephanie said the city's program originally required employers to provide fully paid leave for six weeks to qualify for an exemption; when California expanded state-provided partial paid leave from six to eight weeks, the city—s exemption language created a loophole. "The change in front of you today would strike the words 6 weeks and replace them with at least the number of weeks paid leave is required by California," she said, adding that the change ensures exemptions only apply to employers offering leave more generous than state and city requirements.
Office of Labor Standards and Enforcement director Pat Mulligan and Moore Prendiville were present to answer questions. Supervisors praised the measure and Supervisor Stephanie moved to send it forward to the full Board with a positive recommendation and co-sponsorship; the motion passed unanimously without objection.
