Committee adopts technical fix to sugary-beverage warning ordinance and forwards it to the Board
Summary
Supervisor Scott Wiener secured committee acceptance of a city-attorney amendment that clarifies the grandfathering cutoff for permitted advertising signs (October 20) under the sugary beverage health-warning ordinance, closing a loophole that could have allowed noncompliant signs to be erected before the law took effect.

The committee adopted a city-attorney-recommended technical amendment to the city’s sugary beverage health-warning ordinance and forwarded the ordinance to the full Board with a positive recommendation.
Author Supervisor Scott Wiener told colleagues the change closes an unintended loophole in the original ordinance’s grandfathering language. He said the earlier drafting defined the operative date in a way that could have allowed noncompliant signs to be rushed in; the amendment clarifies that signs permitted on or before Oct. 20, 2015 are exempt and that signs erected after that date must contain the required health warning.
Wiener also read a minor amendment recommended by the city attorney to restore language excluding certain general advertising signs in the same manner as the earlier version. There was no public comment on the item. The committee accepted the amendment and moved the ordinance to the full Board with a positive recommendation.
