Deputy City Attorney John Givner described the vacancy proposal: if a supervisorial office becomes vacant, the mayor (not the Board) would appoint an interim supervisor qualified under charter and state law to serve until a special election; the mayor would have 28 days to appoint in the revised draft (initially 14). Avalos said the change was meant to protect continuity of representation and preserve separation of powers; critics raised concerns about incumbency advantages and dual-office holding.
Nancy Werfel and other public commenters recounted a past episode when District 4 lacked representation for an extended period and urged a mechanism to shorten that gap. Democracy advocates and the San Francisco Elections Commission offered praise for splitting the runoff concept from vacancy rules. The Chamber of Commerce and other speakers raised practical and structural concerns, including the risk a president of the Board might serve extensively as acting mayor.
Chair Avalos summarized the committee—s direction: the vacancy-filling amendment will be continued and refined at the next Rules Committee meeting; the duplicated RCV/runoff file will be continued to the call of the chair. Supervisors took that motion without recorded objection and adjourned.
