Joshua Switsky of the Planning Department explained that the project would satisfy a portion of the developer’s impact fee obligations (Rincon Hill projects are subject to an $11 per‑square‑foot impact fee) by constructing the pathway and granting a permanent public access easement. The Planning Commission had approved the in‑kind agreement; staff and the budget analyst recommended approval and the committee forwarded the resolution to the full Board with recommendation.
