Committee advances technical retirement change to equalize surviving-spouse recognition

Chair David Campos called Item 4, an ordinance introduced by Supervisor Sean Ellspern to amend city retirement qualifications for surviving‑spouse status. Gary Amelio, Executive Director of the Retirement System, presented the item on behalf of the sponsor.
Amelio described the change as a technical provision that would place same‑sex marriages recognized in other states on the same footing as marriages and domestic partnerships recognized under California law, noting the change was motivated by legal developments that followed Proposition 8. He said the change is noncontroversial and that the retirement system does not expect an actuarial cost impact.
Committee members asked for clarification that domestic partners and nonmarried same‑sex domestic partners remain included; Amelio confirmed domestic partners remain part of the definition and that the change aims to equalize treatment. No members of the public spoke on the matter. Supervisor Moore moved a positive recommendation; the committee advanced the item to the full Board without objection.
