Committee advances ordinance to create uniform administrative-fines procedure to full board without recommendation

The Rules Committee considered an ordinance to add Chapter 100 to the Administrative Code establishing procedures governing the imposition, review and appeal of administrative fines.
Sponsor said the ordinance is intended to create consistent procedures across departments that adopt administrative fines. Deputy city attorney Paul Jessen explained the ordinance sets out a procedural framework that will only apply when the board incorporates it into future ordinances and that the text includes lien procedures and notice protections. Jessen noted state law provides an appeal pathway that can be advantageous to the city and to citizens in some cases.
Because the ordinance lacked the environmental finding required by CEQA, the committee adopted an amendment of the whole to add the environmental finding and voted to forward the item to the full board without recommendation to allow environmental review to be completed.
Next steps: The full board will receive the ordinance with the committee's recommendation of "without recommendation" pending environmental review and finalization of text.
