The Springville Planning Commission on Sept. 24 recommended city council approve a general-plan amendment and rezoning for three parcels on Center Street so a homeowner can reconstruct a nonconforming garage.
Staff said the parcels at 920 E. Center, 928 E. Center and 919 E. 100 S. were historically rezoned in the 1990s from R2 to R1-10, leaving several structures nonconforming. The applicant, Travis Menlove, told the commission he only wants to "redo a garage" in the same footprint; the garage currently sits about 3 feet from the property line and the house dates to 1940.
Staff explained that changing the general plan land-use category from Low Density Residential to Medium Density Residential is required to accommodate an R2 zone on the official zoning map. Commissioners discussed setbacks and nonconforming-structure rules: under R1-10, side-yard setbacks for accessory buildings are larger (20 feet street frontage; R2 accessory setbacks can be as little as 3 feet), and city code prevents demolition and rebuilding of nonconforming structures without rezoning or variance. Staff noted that rezoning could, depending on improvements and lot configuration, allow a future maximum of two duplex units on a residual piece of property but said that engineering and subdivision improvements would be required before additional units could be built.
No public opposition appeared at the hearings; Menlove said the change is costly but necessary to reconstruct the garage. The commission voted to recommend the general-plan map amendment and separately recommended the official zone-map amendment, forwarding both items to City Council for final review (the council meeting was noted as Oct. 15 in the transcript).
