The Utah House adopted an amendment and passed Senate Bill 6 on Jan. 31 to update the Utah Anti‑Discrimination Act so it aligns with the Utah Administrative Procedures Act. The amendment clarified an inconsistency between language that made administrative procedures an exclusive remedy under state law and a separate paragraph that permitted actions in state or federal court.
Representative Oakey explained the amendment fixes a drafting oversight so administrative remedies remain the exclusive state remedy while preserving the ability to pursue federal claims where appropriate. Representative Valentine, among others, said the amendment addressed a previously raised concern and urged passage. The House passed the amended bill; the transcript records a vote tally of 47 affirmative and no negative votes.
Supporters characterized the measure as correcting an omission from earlier recodifications so that the Anti‑Discrimination Act operates correctly under existing administrative rules and does not unintentionally preclude federal remedies where applicable. The bill will be returned to the Senate for its further action.
