House approves bill requiring governing-body consent for water-conservancy expansion

The Utah House adopted substitute HB 308 on Feb. 22, requiring water conservancy districts that expand into a new area to obtain written consent from the governing body of that area.
Sponsor Representative Christine R. Fox explained that when expansion affects an area that is a municipality or an area of municipal interest, the signatures of that governing body are required; where annexation or overlapping jurisdictions exist, the county commission's signature would be required. Representative Tanner and others asked clarifying questions about prior practice and who would be considered the governing body in overlapping areas; the sponsor said the bill responds to requests from Utah County Commissioners and addresses concerns raised by municipalities.
The measure passed the House 69-0 and will be forwarded to the Senate.
Next steps: The Senate will consider the bill; local governing bodies will need to adopt procedures for responding to expansion consent requests if HB 308 becomes law.
