House Approves Shift of Diesel Tax Collection to Refinery Rack to Curb Evasion

The Utah House on March 5 approved Senate Bill 252, a measure that moves the point of diesel-fuel tax collection from the retail pump to the refinery/rack level. Proponents said the change reduces opportunities to evade tax collection and simplifies enforcement by reducing the number of collection points the Tax Commission must monitor.
On the floor the sponsor explained that the bill follows the federal approach and is intended to preserve exemptions for bona fide off-highway users such as farmers: "Farmers and other off-highway users will not be required to pay the tax. They can continue to qualify for that exemption," the sponsor said in explanation of intent.
Fiscal analysts, the sponsor said, reviewed other states that have adopted the change and found net revenue improvements when collection shifts to fewer, larger collection points. The House voted to pass the bill; the House minutes record the roll as 60 yes, 10 no. The bill was returned to the Senate for further action.
