House restores original language and advances tobacco‑sale restrictions after contentious floor amendment

First Substitute House Bill 31, addressing the sale of tobacco products, was returned to the floor and debated on Feb. 19. Representative Saunders and Representative James Arne led floor motions that sought to restore the bill to its original form by reinserting multiple sections that had been previously removed and to delete a new section that prohibited the sale of tobacco products outright.

Representative Arne argued the motion would restore the original policy intent and avoid a fiscal note in the tens of millions that would effectively kill the legislation. Floor procedure included a motion to cut off further debate (previous question) and the House then voted on the substantive amendment to reinstate the original language. The motion to amend carried and the House later voted to pass the bill in its amended form; the announced roll call was 60 yes, 12 no.

During floor debate members discussed the fiscal implications and the need to dedicate revenue to tobacco prevention programs. One member urged allocating substantial revenue to prevention, noting that Utah’s prior tobacco tax increase directed only a small portion to prevention. The bill passed and will be forwarded to the Senate for their consideration.
