House creates an Education Fund in H.B. 294 to clarify income‑tax flows to education
Summary
Lawmakers passed H.B. 294 to establish an Education Fund through which income taxes will flow and then be distributed to the uniform school fund and higher education; members amended language to designate the fund for both public and higher education.
On Feb. 14, 2006, Representative Jeff Alexander told the House that H.B. 294 creates a distinct Education Fund to clarify how income taxes are characterized and distributed to education accounts. He said the bill does not change constitutional requirements that uniform school fund dollars go to public education, but it allows lawmakers to refer to dollars for 'education' collectively.
Representative Hogue questioned whether the fund should be designated for public or higher education. Following discussion and a substitute motion from Representative Lawrence, the House amended the language to designate the fund for both public education and higher education so neither is prioritized over the other. The sponsor agreed to check counsel language later if necessary but supported the clarifying amendment.
The House passed H.B. 294 by recorded vote, 71–0, and referred the measure to the Senate.
