Representative Holdaway, sponsor of the House companion, explained the bill would restrict locating centers immediately adjacent to playgrounds and school property. An amendment reduced the prescribed separation distance from 1,000 feet to 500 feet, but added a requirement that any residential rehabilitation center sited within 500 feet provide 24-hour supervision and security measures.
During floor questioning, representatives asked whether the Americans with Disabilities Act (ADA) applies; the sponsor noted that drug and alcohol addiction can be classified as a disability under the ADA and that federal housing and disability law can affect siting. The sponsor and supporters emphasized child safety and urged the requirement for heightened supervision if a facility sits within the specified zone.
The amended bill passed the House unanimously, 69-0, and will be returned to the Senate for further action.
