House approves changes limiting local land‑use rules for school facilities

The Utah House passed Second Substitute House Bill 69 on Jan. 29 after lawmakers adopted technical amendments intended to clarify how counties and municipalities may regulate school construction and inspections.
Representative Larry Wiley introduced Amendment Number 2 and explained edits to several lines of the bill to add and remove permissive language and to clarify where school districts or charter schools have options about inspectors and certificates. He said the changes further clarified the school inspection report or certificate and removed ambiguous language that caused implementation problems.
Representative Morley proposed Amendment Number 3 as a friendly amendment after working with the bill sponsor to resolve concerns; the sponsor described the amendment as acceptable and noted the bill had been developed with input from the State Office of Education, charter schools, the Division of Facilities Construction and Management (DFCM) and building officials.
The sponsors emphasized that state‑adopted life‑safety and International Building Code (IBC) standards remain applicable and that the measure does not allow local municipalities to impose additional restrictions beyond existing codes. “In the area of codes, school buildings ... makes it clear that the IBC and state adopted codes for construction are applicable,” a member of the floor said during discussion.
After debate and summation, the House passed the bill as amended; the floor record shows the second substitute passed with 71 yes votes, 1 no and 3 absent.
What happens next: The bill will be transmitted to the Senate for consideration; sponsors asked the Senate to retain the clarified language to ensure safe school facilities that are compatible with surrounding communities.
