House substitutes e-prescribing bill, delays statewide implementation to 2013
Summary
On Feb. 27, 2012 the Utah House replaced second substitute House Bill 122 with a third substitute to conform to federal e-prescribing language, allow patient pharmacy choice and clinical overrides, and move the state's implementation date from July 1, 2012 to July 1, 2013; the measure passed 70-0.
Representative Vickers moved to uncircle and replace second substitute House Bill 122 with a third substitute to align state law with emerging federal e-prescribing standards and avoid implementation delays. The House adopted the substitute and passed the bill unanimously.
Sponsor Vickers outlined key provisions the substitute clarifies: it preserves a patient's choice of pharmacy when a practitioner transmits an electronic prescription; it permits transmission via an electronic intermediary so long as that intermediary does not override a patient's or prescriber's pharmacy choice; it requires that transmitted information be scientifically accurate and objective; and it allows a prescribing practitioner to electronically override a formulary or preferred-drug status when medically necessary. Vickers also explained that the state's implementation date would be changed from July 1, 2012 to July 1, 2013 to better align with practitioner readiness and federal guidance. "We're trying to get in line with that," Vickers said of federal timelines, and the House waived further debate.
Voting was opened and closed; third substitute House Bill 122 passed the House 70-0 and will be transmitted to the Senate for consideration.
