House OKs process to help owners convert manufactured homes to real property when manufacturer records are missing

House Bill 71 would allow a person whose mobile or manufactured home lacks a manufacturer's certificate or original title (often lost in transit or because the manufacturer no longer exists) to complete a specified affidavit of fixture and complete conversion to real property under defined additional requirements. Representative Roberts, sponsor of the bill, walked members through the current steps (affidavit of fixture, recording with county recorder, certificate of title) and explained the proposal adds a narrowly tailored alternative process with five additional conditions and a template for the DMV and county recorder to use.
"So what this bill does, it's real simple, just adds a provision ... which allows people in this circumstance to complete an affidavit of fixture and convert their mobile manufactured home to real property," Representative Roberts said during his presentation.
The bill requires the unit already be assessed by the county as real property before conversion under this alternative and provides procedural steps for completion at DMV and the recorder's office. The House voted to pass HB 71 by voice and recorded tally (72 yes, 1 no). The bill will be transmitted to the Senate for consideration.
