House passes amended bill tightening 'undue hardship' standard for employer policies

The Utah House on Feb. 26 adopted Amendment 3 to HB242 and passed the measure by voice vote (recorded as 62 yes, 2 no). Representative Miller, sponsor of the amendment and the bill, said the amendment expands and clarifies the definition of "undue hardship" to consider employer size, financial resources and the nature of operations.
"This amendment expands or defines undue hardship to include significant difficulties or expenses considered in relation to the size, financial resources, nature, or structure of the employer's operations," Miller said when presenting the floor amendment. He said the change addressed many of the bodys concerns and that the bill now had broad support, including endorsements from the Utah Association of Counties and the League of Cities and Towns.
Representative DeCaro rose in support and urged passage. Representative Dee expressed appreciation for the sponsor's willingness to add the amendment and stated he would support the bill.
The floor adopted the amendment and passed HB242 as amended. The bill will be transmitted to the Senate for its consideration.
Floor remarks emphasized the bills intent to balance employee protections and practical limits for employers and noted the amendment was negotiated to address earlier concerns.
