House creates task force to study rehiring of retirees and URS impacts after lengthy debate

The Utah House on Feb. 20 approved second substitute HB 77 to create a post-retirement employment task force charged with studying the effect of rehiring retirees on the Utah Retirement System (URS) and the consequences of earlier reform (SB 43, 2010).

Representative Cunningham, sponsor of the substitute, described long-standing concerns from police departments, fire districts and school systems about filling qualified positions. He said attempts to assess the impact of earlier legislation were frustrated by inconsistent or missing data from URS: "The data is either unavailable, URS is unable to give us the data, or is unwilling to," he said, arguing the task force is necessary to produce accurate findings.

Cunningham reviewed prior audits and actuarial estimates, noting broad market losses and unfunded liabilities in prior years and that SB 43 addressed some loopholes but "on its own will not solve the challenges of the unfunded liability." He recommended a study task force to evaluate whether additional changes are needed.

Representative McKay, who supported the bill, described it as "a good accommodation" to verify whether policy changes had their intended effect. Representative Powell said the task force could bring data and findings to the Legislature so members will have clearer answers for constituents on so‑called "double-dipping" or post-retirement reemployment issues.

After floor discussion and a sponsor summation clarifying intent and denying any personal intention to run for state treasurer, the House voted to pass second substitute HB 77 by 71 yeas and 1 nay. The measure will be referred to the Senate for consideration and will create a formal study process for evaluating post-retirement reemployment and URS impacts.

Next steps: HB 77 will be considered by the Utah Senate; the task force will collect data and report back with recommendations to the Legislature if enacted.
