House approves enterprise-zone overhaul aimed at more oversight for rural incentives

Representative Bridal, sponsor of House Bill 31, told the House HB 31 refines the enterprise-zone program to add oversight and improve accountability. "We came up with HB 31 which creates an application for someone wanting to be a participant in an enterprise zone tax credit that will go through GOED, will be approved by them and then forwarded to the State Tax Commission before it's incented," Bridal said.
Bridal said the program had grown substantially and that past law lacked authority to vet applications before tax incentives were granted. She explained that removing a 501(c)(3) component and adding pre-incentive vetting reversed an earlier fiscal note and produced a positive fiscal estimate of roughly $440,000. She said the bill also increases eligibility thresholds to counties under 70,000 population and cities under 20,000, aiming to help rural economic development.
Members asked whether previously incented projects would be grandfathered and about short-term education-fund impacts. The sponsor said the bill does not apply retroactively to 2015 applications and has an effective date of Jan. 1, 2016; she and fiscal staff explained that some later positive revenue is post-performance and not always captured in fiscal notes. Supporters described HB 31 as an important tool for rural Utah and urged passage.
The House opened and closed voting: HB 31 passed the House 74-0 and was referred to the Senate.
