House clears land-use amendments to protect property vesting and clarify bonding

Representative Matt Schultz presented HB377 as a product of the land use task force and summarized three principal changes: (1) require a city to grant a building permit when infrastructure has been properly bonded; (2) clarify vesting law so developers are governed by ordinances in place when an application is complete; and (3) limit mitigating conditions on conditional use permits to those reasonably related to the detrimental impacts of the land use.
Schultz said the bill aims to balance property owner rights with local land-use ordinances. Representatives asked clarifying questions about bonding, recording plats and how vesting applies at different stages of a development; the sponsor answered that bonding rules are not changed but clarified, and that bonding guarantees completion before issuance of occupancy where applicable. The House passed HB377 67–0 and will transmit it to the Senate.
