Senate advances water‑export review bill to let state better scrutinize out‑of‑state proposals

Senator Finlayson, speaking for the Energy, Natural Resources and Agriculture Committee, said the bill creates a new administrative chapter to require additional review whenever someone seeks to convert an in‑state water use to an out‑of‑state use. The sponsor emphasized the measure does not ban exports — Senate staff described it as a process to allow the State and the State Engineer to take a ‘‘very hard look’’ at applications to ensure they are in Utah’s interest and consistent with constitutional constraints on commerce.
Senators questioned how the bill would treat existing contracts and whether the state could give public notice in neighboring states that might be affected. The sponsor said there were no existing contracts currently in place that would export Utah water and that any application filed after the bill’s effective date (identified on the floor as 60 days after the governor signs) would be subject to the new chapter. The chair also noted the bill team had worked to avoid constitutional infirmities recognized by federal courts in related interstate water disputes.
After questions on advertising and reciprocity notice to nearby states, the Senate agreed to place the bill on the third‑reading calendar.
