Senate amends administrative-rules reauthorization language to allow immediate effect

Senate Bill 1,001, dealing with administrative rules reauthorization, was debated and amended on June 18, 1997. Senators adopted language under suspension of the rules to clarify when the act would take immediate effect: if approved by two-thirds of members of each house the act takes effect upon governor approval or on the date provided by the Utah Constitution absent a signature.
The clerk read a governor’s proclamation and communications that placed SB1001 on the special session call. Staff notified the floor that a technical amendment was required on page 3, line 18 to provide immediate effect language and that amendment language was prepared and considered under suspension of rules. The body recognized the need to address an oversight on page 3, line 12 to reinstate language related to rules reinstatement and to ensure future errors could be addressed without a special session in certain circumstances.
After debate and the insertion of constitutional-effective-date language, the Senate voted to pass the bill and transmit it to the House. The chamber subsequently received House concurrence/amendments on timing (moving an April reference to June 15) and then concurred in the House changes; final signatures and enrollment steps were taken.
