Senator Ron Allen introduced Substitute Senate Bill 146, saying the bill ‘‘deals with performance of unlawful marriages’’ and ‘‘specifically singles out and strengthens the minor marriages’’ so the state can investigate and prosecute situations involving forced marriages of minors. He told the chamber he would forward documentation of alleged child marriages to the attorney general's office to support enforcement.
An amendment offered by Senator Valentine sought to delete a phrase that referenced the authorization under section 30-1-6 to solemnize a marriage (the amendment targeted page 2, lines 47–48 in the bill copy used on the floor). Proponents of the deletion argued the cross-reference would create an unintended loophole allowing some solemnizers to claim statutory authorization and thus avoid felony exposure; they said removing the phrase would ensure uniform third-degree felony treatment for those performing unlawful marriages involving minors.
Senator Allen characterized the amendment as "friendly," arguing that removing the narrow cross-reference would close a loophole abusers could exploit. Opponents warned that narrow deletions could create disparities or strip discretion. The Senate called for a division vote on the amendment; after a standing division the President Pro Tem ruled the amendment failed.
