Senate advances a string of bills: telemarketing, referendum changes, rules and annexation measures pass
Summary
On Jan. 21, 2004 the Utah Senate advanced multiple measures: SB 27 (telephone/facsimile solicitation) passed unanimously; SB 10 (local referendum signatures) passed; SR 2 (rules amendment) passed; SB 18 (municipal annexation in first-class counties) passed; and first substitute SB 68 advanced to third reading.
The Utah Senate advanced several bills and resolutions during its Jan. 21 session, moving a number of measures on to the next stage of the legislative process.
Senate Bill 27 (Telephone and Facsimile Solicitation Act): Presented by Senator Thomas, the bill updates the state do-not-call list to conform with new FCC rules. Senator Thomas said the bill simply brings Utah law "in line with the new FCC rules." The Senate recorded a roll-call vote of 27 ayes, no nays; SB 27 passes and will be referred to the House for further consideration.
Senate Bill 10 (Amendments to local referendum process): Senator Hickman noted the bill was amended in committee to set the signature-collection period to 60 days (it had previously been expanded from 35 to 45 and then amended to 60). After no floor questions, the Senate recorded 27 ayes, no nays and 2 absent; SB 10 passes and will be referred to the House.
Senate Rules Resolution 2 (SR 2): Senator Hilliard called the question on a technical rules amendment that routes certain bills through the rules committee. The roll-call vote recorded 27 ayes, no nays and 2 absent. SR 2 will be signed in open session and referred for enrolling.
Senate Bill 18 (Municipal Annexation Provisions in First-Class Counties): Senator Arendt said the bill had substantial input from county officials, the Utah League of Cities and Towns and other local entities. The Senate vote recorded 26 ayes, no nays and 3 absent; SB 18 passes and will be referred to the House.
First substitute Senate Bill 68: After debate and a call of the question, the Senate voted 27–0 (2 absent) to advance the first substitute of SB 68 to the third-reading calendar. A floor remark in the record stated that, as written, the bill would prohibit state funding of abortions if enacted.
Procedural notes: The Senate adopted rules committee recommendations (with one bill removed from the assignment list at the sponsor's request), moved to a time-certain to consider property-rights amendments and adjourned until 10:00 a.m. the following day.
