Senator Romero expressed concern that setting aside litigation money could send an unintended message to potential challengers and might discourage negotiation. "I guess I'm a little concerned that perhaps this could send, a message we don't intend to send," Romero said, urging consideration of front-end mediation requirements for major disputes.
Kilpach responded that the bill does not prevent petitioning, negotiation or compromise and that early transparency about concerns would be welcome.
The Senate voted to read the bill for a third time, with the clerk recording 22 yes votes, 3 nay votes and 4 absent; the measure moved toward third-reading consideration.
Next steps: SB240 was advanced toward third reading; if passed in final form it would appropriate $5 million to a litigation-restricted account for the Mountain View Corridor with residuals earmarked for the LeRay McAllister fund.
