Senate Advances Dozens of Bills on Consent and Third-Reading Calendars, Including Background-Check and Election-Law Changes

The Utah Senate placed a package of bills on the calendars or approved final passage on a range of topics including background checks for disability services, election-law deadlines, unclaimed property timing, motor vehicle arbitration and multiple homeowners’ association and hunting-license changes.
The Utah Senate moved a broad set of bills through the consent, concurrence and third-reading calendars in a morning session that covered public-safety, election administration, property and regulatory matters.
On the consent calendar, senators approved a number of measures by unanimous or near-unanimous voice and roll-call votes. Senate Bill 219, a real-estate technical change to allow certain deed types to convey after-acquired title (while preserving limits on quitclaim deeds), passed by unanimous consent and was referred to the House. Senate Bill 182, aligning state child-support review rules for TANF recipients with a federal Debt Reduction Act requirement, passed 29–0.
The Senate also approved House Bill 201 to clarify the hierarchy for local smoking ordinances (28–0, to be signed by the President in open session) and considered a cluster of election-law measures (House Bill 61) that modify nomination-challenge deadlines, certification dates and public-notice timing; HB 61 passed and will be returned to the Speaker for signature.
On third reading, the chamber took up a range of bills. Senate Bill 59 (youth fishing-license exemptions for organized youth groups with education requirements) was amended and advanced; House Bill 5 (Internet predator penalties) was replaced by a first substitute and then tabled on third so sponsors could obtain an amended fiscal note. House Bill 211, implementing background-check requirements for persons and contractors working with people with disabilities under provisions of the federal Adam Walsh Act, received a roll-call final passage vote of 29–0.
Several homeowners association and arbitration-related bills were amended and passed, including the motor-vehicle-insurance arbitration clarification in House Bill 44 (amendment requires arbitration agreements to be in writing) and a first-substitute to Senate Bill 87 on HOA contract termination presumptions that passed as amended. Hunting-license fee adjustments (Senate Bill 161) were debated and advanced on second reading with a recorded vote that transmitted it to the House.
The Senate recorded a mix of unanimous voice votes and roll-call tallies across the morning’s calendar; when votes included named tallies, the clerk’s record supplied the counts. Procedural actions included numerous circlings and uncirclings (temporary holds), floor amendments and motions to place bills on calendar order. The Senate recessed for a scheduled 2:00 PM session after a committee-of-the-whole presentation later in the morning.
