Utah Senate unanimously confirms governor’s appointments in extraordinary session

SALT LAKE CITY — The Utah State Senate convened an extraordinary session on Oct. 2, 2007, to consider and consent to appointments made by Governor Jon M. Huntsman Jr. The senate adopted temporary rules for the session and, after a roll-call vote, confirmed the governor’s slate by a 24-0 tally with five senators absent.
The session opened at noon with a prayer and the Pledge of Allegiance. A certificate from the Office of the Lieutenant Governor was read, stating that Governor Huntsman had issued a proclamation under Article 7, Section 6 of the Utah Constitution calling the senate into extraordinary session for the specific purpose of consenting to appointments made since the close of the 2007 general session. The certificate was read into the record by a clerk who identified the proclamation date as Oct. 2, 2007.
Leslie McLean read the governor’s communication listing appointments and reappointments to several state boards and commissions, including (as read into the record) Robert P. Micah (reappointment) to the Utah Capital Investment Board; Preston Lewis Jackson to the State Board of Financial Institutions (replacing James C. Anderson); Mark Cornelius (reappointment); Douglas L. DeFries (appointment); Robert M. Watcott (appointment); Jill Miller (appointment to replace Anne Watson on the Utah Arts Council board); Derek Perra (appointment to the Utah Athletic Foundation board to replace Nikki Stone); Melvin R. Brown (reappointment); Doral L. Vance (reappointment); and Fox Echols (reappointment). The clerk’s reading stated the appointments were transmitted "in accordance with Utah code annotated 67-1-1 and 2." The reading concluded with a signature block naming Governor John M. Huntsman Jr. and Lieutenant Governor Gary R. Herbert.
Senator Bramble moved that the senate consent to the governor’s appointments "as listed in his communication dated 10/02/2007 as read by Leslie McLean." The motion proceeded to a roll-call vote. The clerk announced the result: "24 yes votes, 0 nay votes with 5 being absent." The president subsequently declared, "The governor's appointments are confirmed." The motion’s mover was recorded as Senator Bramble; no second was specified in the transcript.
Before the vote, the senate took roll call and established a quorum of 24 members present with five absent; three absences were excused (Senators Eastman, Hilliard, and Maine). President Valentine noted health concerns for Senator Maine and Representative Carl Duckworth and asked members to keep them in their prayers.
After the confirmations, the committee appointed to wait upon the governor’s representative reported it had notified the representative that the senate was in session and ready to do business and later reported the committee informed the representative that the senate had completed its business. With no further business recorded, Senator Bramble moved to adjourn and the body adjourned the extraordinary session.
