Salt Lake City — The Senate advanced Senate Bill 160, which sponsors described as protecting family choice for placement at the Utah State Developmental Center and ensuring compliance with federal waivers governing funding for care of people with developmental disabilities.
Senator Dayton said the bill recognizes that for some severely disabled adults institutional intermediate-care facilities (ICF/MR) remain the least restrictive and safest option. Dayton cited federal waiver language and the Developmental Disabilities Assistance and Bill of Rights Act as part of the statutory and regulatory background that requires choice and compliance.
Senators who supported the bill highlighted that some families prefer or require the intensive services the center provides. Senator Robles noted concerns about an 18-month freeze on the DSPD waiting list, warning that lack of movement constrains community-care options and family ability to keep loved ones at home. Senator Bramble disclosed a personal connection and expressed support on grounds of choice.
Senator Dayton said the center’s census had fallen (217 residents in a facility with 260 capacity), noting cost-per-resident considerations and the array of services provided on site. After discussion, Senate recorded a roll call and announced SB160 passed 22–3 and was placed on the third-reading calendar.
The measure will next appear on third reading for final passage.
