Utah Senate Convenes Extraordinary Session and Consents to Governor’s Appointments

The Utah State Senate convened an extraordinary session on Oct. 5, 2010, and moved quickly to consider and consent to a list of appointments submitted by Gov. Gary R. Herbert. The Senate first adopted the rules for the extraordinary session and then voted to approve the governor’s nominees.
Greg Bell, lieutenant governor, read a proclamation and certification calling the Senate into the twelfth extraordinary session under Article 7, Section 6 of the Utah Constitution for the purpose of consenting to gubernatorial appointments. The proclamation set the session at 1:30 p.m. on Oct. 5, 2010.
Senator Dayton moved to adopt the existing rules for the extraordinary session; the motion was approved by voice vote. The presiding officer then appointed a committee to wait on the governor, naming Senator Jerry Stevenson as chairman with Senators Stuart Adams and Ben McAdams as members. Senator Stevenson later reported a representative from the governor’s office had joined the Senate.
The reading clerk presented a slate of appointments transmitted in writing by the governor. The list included appointments and reappointments to the Utah Digital Health Service Commission (for example, Douglas James Hasbrook to replace Joseph Grant Kramer, and Henry Wallace Gardner to replace Rulon J. Barlow), the Utah Arts Council Board of Directors (Philip Mozel as a community representative), the Health Data Committee (Gordon Crabtree and Lauren Opel Florence), the Utah Conservation Commission (Douglas D. Bateman replacing Ben A. Thurgood; Douglas Guy Pace replacing Randy A. Greenall; Paul B. Leishman reappointed; Wendell Stembridge reappointed), the Utah Capital Investment Board (Taylor Bridal replacing Lonnie M. Bullard), the Weber State University Board of Trustees (Kevin Sullivan replacing Jerry W. Stevenson) and the Utah State University Board of Trustees (Frank Piza appointed), among others. The reading concluded with the governor’s signature line, "Sincerely, Gary R. Herbert."
Senator Hilliard moved that the Senate approve the list as read and consent to the appointments as required by statute. The clerk called the vote; senators responded in the affirmative. The presiding officer announced the roll showed 26 voting in favor with 3 absent and declared that the Senate had consented to the appointments. The presiding officer congratulated the nominees and stated the committee would inform the governor that the Senate had completed its business.
With no further items from the governor, Senator Jenkins moved to adjourn and "sign the die." The motion carried on a voice vote and the Senate adjourned.
The extraordinary session was procedural and limited in scope: its stated, sole purpose was to consider and consent to gubernatorial appointments made since the close of the 2010 general session. No substantive debate about the individual nominees or their qualifications is recorded in the transcript.
