Senate clears a package of retirement and post-retirement employment bills

Senator Lilienquist presented first substitute Senate Bill 308 as a cleanup and contingency package for the Tier 2 retirement system enacted last year, telling the Senate the bill responds to actuarial recommendations and adds mechanisms the Legislature and retirement board could use if the defined-benefit portion of the hybrid plan fell under duress. "If the defined benefit portion of that new Tier 2 system starts to come under duress...there are a couple of ways the legislature and the Board and Membership Advisory Council and also the Utah Retirement System can address issues," he said. The substitute also clarifies the treatment of the firefighters' insurance premium across tiers and allows new employees a 30-day affirmative election window with the option to change within the first year.
Senate Bill 127 clarifies post-retirement employment rules after an earlier change limited reemployment. The sponsor said the bill allows retirees to return in part-time roles without forfeiting retirement benefits up to $15,000 or half of the retirement allowance (whichever applies), while preserving a one-year separation rule for full reemployment.
Senate Bill 120 (second substitute) creates an optional pay-for-performance pilot for the Department of Workforce Services and extends the review period for a small number of cases still pending under the old Career Services Review Board rules.
Floor votes: SB308 passed (first substitute) with a recorded tally indicating 24 yeas, 0 nay, 5 absent; SB127 passed with recorded yeas reported; SB120 passed as substituted with 22 yeas, 0 nay, 7 absent. Sponsors said administrative steps (onboarding materials, benefits fairs, and letters before deadlines) will support new employees making plan elections.
