Utah Senate Confirms Governor's Appointments in Extraordinary Session

The Utah State Senate convened in a third extraordinary session on Sept. 6, 2011, to consider gubernatorial appointments and consented to the slate as read from the governor's proclamation and communications. President Wannop announced the session was called under a proclamation from Gov. Gary R. Herbert that cited the state constitution and scheduled the Senate for 1:30 p.m. for the purpose of considering appointments.
Senator John L. Valentine, chair of the Senate Business and Labor Confirmation Committee, told the chamber the confirmation committee had voted unanimously to recommend Constance B. White for the Alcoholic Beverage Control Commission and Francine Gianni to serve as Executive Director of the Department of Alcoholic Beverage Control (DABC). "We had a very good public debate on both of those nominees. We felt very comfortable with recommending both of them to go forward," Valentine said.
Senator Robles asked whether Gianni would continue to serve as Executive Director of the Department of Commerce while taking on the DABC position and whether she would receive additional pay. Valentine summarized the committee's inquiry and the nominee's response: the nominee indicated she would serve as executive director (not an interim or temporary appointment) and that she was "only receiving the compensation permitted to her by statute as the director of Department of Commerce and has not received any additional compensation or financial benefits from serving as the Executive Director of the Department of Alcoholic Beverage Control." The committee also reported that the process for the DABC appointment complied with the statutory recommendation and nomination procedure.
The Senate proceeded to the question: Senator Hilliard moved that the Senate consent to the governor's appointments as read. The President announced the confirmation vote as 25 yeas, 0 nays, with four absent, and stated, "We have consented to the governor's appointments as read." Senators Hinkins, Anderson and Robles were appointed to notify the governor's representative that the Senate had completed its work, and Senator Hinkins later reported the governor had no further business for the Senate.
The appointments read into the record covered multiple boards and commissions across state government, including (among others named in the governor's transmission) representatives to the Board of Parks and Recreation; nominees to judicial district representative slots for higher-education boards; reappointments to various state boards; and appointments to the Department of Alcoholic Beverage Control leadership. The Senate did not act on one listed Board of Regents appointment at this session because of a discovered statutory residency requirement; that nomination was delayed pending review of the applicable law.
The session concluded after the confirmations; Senators then moved to adjourn. President Wannop announced the adjournment following a successful consent vote and an announced motion to adjourn.
